These Terms of Service ("Terms") govern your relationship with Kamil Dasko T/A Dasko-JDM Direct ("Dasko-JDM", "we", "us", or "our"), a sole proprietorship registered at Unit 38, Merrywell Business Park, Drumree, Co Meath, Ireland. By submitting the order form on our website www.dasko-jdm.com and initiating the vehicle purchase process, you ("Customer", "you") agree to be bound by these Terms. If you do not agree to any part of these Terms, please do not proceed with the submission.

1. Parties

1.1 Dasko-JDM Direct: Kamil Dasko T/A Dasko-JDM, acting as an intermediary service provider and vehicle sourcing agent, registered at Unit 38, Merrywell Business Park, Drumree, Co Meath, Ireland.

1.2 Customer: The individual or legal entity completing the vehicle purchase form on www.dasko-jdm.com and engaging Dasko-JDM to facilitate the purchase and import of a vehicle from Japan.

2. Definitions

2.1 Territory: Japan

2.2 Item: Any vehicle, part, machinery, or related product sourced by Dasko-JDM on behalf of the Customer

2.3 Website: www.dasko-jdm.com

2.4 Transaction: The full process facilitated by Dasko-JDM, including sourcing, bidding, negotiating, purchasing, and shipping Items from Japan

2.5 Deposit: The initial payment made by the Customer after order form submission, confirming intent to proceed with a purchase

2.6 Balance: Remaining amount due after Deposit, payable within 14 calendar days of Deposit clearance

2.7 Invoice: A final commercial document detailing the full cost of the purchase

2.8 Proforma: A preliminary invoice provided before full payment

2.9 Bid: An offer made at Japanese auctions on the Customer's behalf

2.10 Email: The Customer's registered email address provided in the order form

2.11 Seller: The auction house, dealership, or individual in Japan who owns and offers the Item for sale. For clarity, Dasko-JDM is not the Seller, but acts solely as a sourcing and logistics intermediary.

3. Privacy and Data Protection

3.1 We collect your name, contact details, billing info, vehicle preferences, IP, and usage data through our secure cloud-based system. This information is stored securely and used only for processing orders, improving service, and meeting legal obligations.

3.2 We do not sell your data. We may share data with service providers (e.g., logistics partners, customs agents) under strict confidentiality.

3.3 Your data is stored on a secure, encrypted cloud server. We keep records only as long as needed for legal or operational reasons.

3.4 Under GDPR, you have rights to access, correct, erase, or object to data processing. To exercise your rights, contact: import@dasko-jdm.com.

4. Communication

4.1 Email is the only formal and legally recognised channel of communication. All official notices, agreements, amendments, or claims must be sent in writing to import@dasko-jdm.com.

4.2 Before making a Deposit, Customers may choose their preferred informal communication method (e.g. phone, WhatsApp, chat) for general updates or convenience. However, these are considered secondary channels and carry no legal or contractual validity.

4.3 Dasko-JDM is not responsible for missed or delayed communication on any unofficial channels.

4.4 Customers are required to monitor their email regularly and respond to Dasko-JDM inquiries in a timely manner. Failure to do so may result in delays or misunderstandings for which Dasko-JDM is not liable.

4.5 Any agreement modifications, cancellations, claims, or payment confirmations must be confirmed by email. Unconfirmed verbal or text communications do not constitute valid notice.

5. Deposits & Payments

5.1 To initiate the vehicle sourcing process, the Customer must pay a Deposit. The standard Deposit is 10% of the estimated purchase price, with a minimum of €2,000, whichever is greater.

5.2 The Deposit confirms the Customer's interest and secures their place in the queue. However, Dasko-JDM does not begin any bidding or negotiation until the full balance has been paid and cleared.

5.3 The remaining balance must be paid within 14 calendar days of the Deposit clearing unless otherwise agreed in writing.

5.4 Only bank transfers or cash payments are accepted. PayPal and similar services are not supported. A full VAT invoice will be issued for all payments.

5.5 Dasko-JDM does not accept screenshots, payment advice slips, or transfer confirmations as valid proof. Only cleared funds in our bank account are recognised.

5.6 Deposits are refundable within 14 calendar days of payment unless the Customer signs a Waiver of Cancellation Rights, which makes the Deposit non-refundable and authorises Dasko-JDM to commence work immediately.

5.7 If no waiver is signed, the Customer enters a 14-day cooling-off period, during which no work will begin, and the Customer may cancel for a full refund of the Deposit.

6. Balance Payment Terms

6.1 Balance payments must be completed on time. Delays may result in cancellation and forfeiture of funds.

6.2 Payment is confirmed only upon arrival of cleared funds in our account.

6.3 Auction cancellation penalties, or reselling costs due to late payments will be charged to the Customer.

7. Bidding Process

7.1 Official Bids are placed via auction systems. Informal bids (via phone or chat) carry no guarantee.

7.2 Sellers may cancel Items before auction closes. If this occurs, we may negotiate a direct sale with the seller

7.3 Dasko-JDM may bid up to €1,000 more than your maximum limit to win the Item.

7.4 Inspection sheets are shared when available. Final decisions must be based on inspection data, and we are not responsible for condition misinterpretation.

8. Shipping & Documentation

8.1 Only fully paid and document-ready Items will be booked for shipping.

8.2 Bill of Lading and Export Certificate will be sent by express courier.

8.3 We do not guarantee document arrival before the vessel reaches destination due to courier delays.

8.4 Insurance is optional and must be requested by the Customer at time of purchase. We are not responsible for any damage or loss not covered by requested insurance.

9. Vehicle Condition & Liability

9.1 We do not guarantee mechanical condition. We rely on official auction sheets and dealer information.

9.2 We are not liable for import compliance in your country. Please ensure the vehicle meets all local regulations.

9.3 No post-auction cancellation or condition-based refund will be accepted.

10. Cancellation

10.1 You may cancel your order within 14 calendar days of Deposit payment unless a waiver is signed.

10.2 After waiver signature, the transaction becomes binding.

10.3 Dasko-JDM reserves the right to cancel orders in the event of force majeure or Customer payment default.

10.4 Cancellation refunds may be reduced by administrative or auction-related penalties.

11. Intellectual Property

11.1 All inspection reports, documents, and translations provided by Dasko-JDM remain our property.

11.2 You may not copy, distribute, or commercially use our content without permission.

12. Governing Law

12.1 These Terms are governed by the laws of Ireland.

13. Modifications

13.1 We may update these Terms at any time. Updated Terms will apply only to future orders.

13.2 To amend an existing agreement, both parties must agree in writing via email.

14. Final Provisions

14.1 By submitting your order form and paying the Deposit, you confirm acceptance of these Terms.

14.2 If any clause is found unenforceable, the remainder shall remain valid.

14.3 You may not assign this agreement without Dasko-JDM's written consent.
