IMPORTANT CONSUMER NOTICE
These Terms of Service apply exclusively to private consumers acting outside the scope of any business, trade, or profession.
Dasko-JDM Direct acts solely as an intermediary and sourcing agency.
Dasko-JDM Direct is not the seller of vehicles.
Your statutory consumer rights under EU and Irish law are not affected by these Terms.
1. PARTIES
1.1 Service Provider
Kamil Dasko T/A Dasko-JDM Direct, sole trader registered in Ireland, with registered address at:
Unit 38, Merrywell Business Park, Drumree, Co. Meath, Ireland. ("Dasko-JDM", "we", "us", "our").
1.2 Consumer
A natural person acting for purposes outside their trade, business, or profession who submits an order form via www.dasko-jdm.com ("Consumer", "you").
2. DEFINITIONS
2.1 Territory – Japan
2.2 Vehicle – a car or related goods sourced on behalf of the Consumer
2.3 Transaction – sourcing, verification, purchase coordination, export, shipment, and registration support
2.4 Seller – auction house, dealership, or private seller located in Japan
2.5 Security Deposit – client funds confirming commitment to the sourcing process
2.6 Management Fee – service fee payable to Dasko-JDM for handling the import process
2.7 CIF Value – Cost, Insurance, and Freight value of the vehicle, including purchase price, Japan-side costs, and ocean shipping
2.8 Balance – remaining funds payable for the vehicle and related costs
2.9 Email – the Consumer's registered email address
3. ROLE OF DASKO-JDM
3.1 Intermediary Status
3.1.1 Dasko-JDM acts exclusively as an intermediary and sourcing agent.
3.1.2 Dasko-JDM is not the seller of the Vehicle.
3.1.3 Ownership of the Vehicle transfers directly from the Seller to the Consumer.
3.2 No Ownership or Control
3.2.1 Dasko-JDM does not own, store, manufacture, or modify the Vehicle.
3.2.2 Vehicle condition and information are based on third-party data.
4. COMMUNICATION
4.1 Official Communication
4.1.1 Email is the primary and legally recognised communication channel
4.1.2 All confirmations, approvals, and notices must be made via Email.
4.2 Informal Channels
4.2.1 Phone calls or messaging apps may be used for convenience only.
4.2.2 Informal communications are not legally binding unless confirmed by Email.
5. CONSULTATION AND BUDGET CONFIRMATION
5.1 The begining of the process
5.1.1 The process begins with a consultation after the Consumer submits a form through the website.
5.1.2 During this stage, Dasko-JDM reviews the Consumer's requirements, intended use of the vehicle, and total planned budget. This allows both parties to confirm that the project is realistic before any sourcing activity begins.
5.2 During this stage:
- the Consumer's vehicle preferences are discussed,
- the total "on-the-road" budget is confirmed,
- and an estimated cost breakdown is provided.
5.3 Sourcing and purchase activity
5.3.1 No sourcing, reservation, or purchase activity will begin until the Security Deposit has been received and cleared in the Dasko-JDM bank account. The deposit confirms the Consumer's commitment to proceed with the process and enables Dasko-JDM to dedicate time and resources to the project.
6. SECURITY DEPOSIT
6.1 Deposit Requirement
6.1.1 To begin the sourcing process, the Consumer must pay a refundable Security Deposit.
6.1.2 The deposit confirms the Consumer's intention to purchase a vehicle and allows Dasko-JDM to begin sourcing.
6.2 Deposit Structure
The required deposit depends on the Consumer's total planned budget:
- Up to €15,000 budget: €1,500 deposit
- €15,000 to €30,000 budget: €2,500 deposit
- Over €30,000 budget: 10% deposit
6.2.1 The exact deposit amount is confirmed with the Consumer in writing before any services begin, based on the agreed total budget and project scope.
6.3 Use of Deposit
6.3.1 The deposit is credited toward the vehicle purchase and forms part of the total funds used to secure the selected vehicle.
6.3.2 The deposit is separate from the Management Fee and does not cover the cost of Dasko-JDM's services.
6.3.3 The Management Fee is calculated independently, based on the CIF value of the vehicle, and is confirmed once the vehicle has been shipped and final costs are known.
7. RIGHT OF WITHDRAWAL
7.1 Under EU consumer protection law, the Consumer may request a full refund of the deposit within 14 days of payment.
7.2 If the Consumer requests that services begin immediately, they may be required to sign a Waiver of the Right of Withdrawal.
7.3 If the Consumer selects a vehicle for purchase within the 14-day period, the waiver must be signed before the purchase proceeds.
8. SOURCING AND VEHICLE SELECTION
8.1 After the deposit is received, Dasko-JDM begins sourcing vehicles based on the Consumer's requirements and budget.
8.2 As part of the sourcing process, Dasko-JDM:
- monitor 140+ auction houses and dealer networks,
- review vehicle documentation,
- provide condition reports,
- prepare cost estimates.
8.3 The Consumer selects a vehicle based on estimated costs.
8.4 A full cost breakdown is provided before any purchase is made.
8.5 No vehicle is purchased without the Consumer's written approval.
9. VEHICLE PURCHASE AND BALANCE PAYMENT
9.1 Once the Consumer selects and approves a specific vehicle, the purchase process begins.
9.1.1 During the sourcing stage, Dasko-JDM presents suitable vehicles based on the Consumer's requirements and budget. For each vehicle, the Consumer receives key information, including available documentation, condition details, and a full estimated cost breakdown.
9.1.2 If the Consumer decides to proceed with a particular vehicle, written approval must be provided via Email. This approval confirms that the Consumer accepts the estimated costs and authorises Dasko-JDM to complete the purchase on their behalf.
9.1.3 Only after this written approval is received does Dasko-JDM proceed with the transaction using the deposit already in place. Once the purchase is completed, the Consumer is required to pay the remaining balance in accordance with the payment terms set out in these Terms.
9.2 After-purchase confirmation.
9.2.1 After the vehicle purchase is confirmed, the Consumer will receive a final invoice showing the remaining balance for the vehicle and shipping. This invoice reflects the actual purchase price and confirmed third-party costs.
9.2.2 The Consumer must transfer the remaining balance within 3 working days of receiving the purchase confirmation. This payment is required to allow the export, documentation, and shipping process to proceed without delays.
9.3 Failure to pay within this period may result in:
- transaction cancellation,
- seller penalties,
- and associated costs being charged to the Consumer.
10. MANAGEMENT FEE
10.1 Nature of the Fee
10.1.1 The Management Fee is the service fee for handling the full import process from start to finish.
10.1.2 It covers:
- sourcing coordination,
- purchase execution,
- logistics and export handling,
- shipping coordination,
- customs and registration management,
- final handover support.
10.1.3 Additional inspections, specialist reports, or enhanced condition checks may be arranged at the Consumer's request. Any such services are subject to third-party availability and will be charged separately, with the cost confirmed in advance.
10.2 Fee Structure
The Management Fee is calculated based on the CIF value:
- Up to €21,500 CIF: €1,500 fixed fee
- €21,500–€50,000 CIF: 7% of CIF value
- Over €50,000 CIF: negotiated premium rate
10.2.1 The exact Management Fee is confirmed once the vehicle has been shipped and all costs are finalised.
11. CONSUMER COSTS
11.1 Unless otherwise agreed in writing, the Consumer is responsible for all third-party costs, including but not limited to:
- vehicle purchase price,
- inland transport in Japan,
- export and port charges,
- ocean shipping,
- marine insurance,
- customs clearance fees,
- import duties,
- VAT,
- VRT,
- excise duties,
- compliance or modification costs,
- bank and currency exchange fees,
- courier or documentation fees,
- port storage or delay charges.
11.2 All cost estimates are indicative and may change due to third-party factors.
12. SHIPPING, DOCUMENTATION AND INSURANCE
12.1 Shipping is arranged after the required payments are received.
12.2 Export documents will be sent to the Consumer by courier.
12.3 Delivery times for documents are not guaranteed.
12.4 Insurance must be requested by the Consumer at the time of purchase. Dasko-JDM is not responsible for losses not covered by insurance.
13. VEHICLE CONDITION AND COMPLIANCE
13.1 Vehicles are purchased based on third-party information.
13.2 No mechanical or cosmetic guarantees are provided by Dasko-JDM.
13.3 This clause does not limit statutory consumer rights.
13.4 The Consumer is responsible for ensuring compliance with Irish regulations, unless otherwise agreed.
14. CANCELLATION AFTER PURCHASE
14.1 Once a vehicle has been purchased on the Consumer's behalf, cancellation may not be possible due to Seller rules.
14.2 Any available refunds may be reduced by:
- seller penalties,
- administrative costs,
- or third-party charges.
15. LIMITATION OF LIABILITY
15.1 Nothing in these Terms limits liability that cannot be excluded under Irish or EU law.
15.2 Where permitted by law, Dasko-JDM's liability is limited to the Management Fee paid.
16. INTELLECTUAL PROPERTY
16.1 All reports, documents, and materials provided remain the property of Dasko-JDM unless otherwise agreed.
17. GOVERNING LAW AND JURISDICTION
17.1 These Terms are governed by the laws of Ireland.
17.2 Irish courts have jurisdiction over any disputes.
18. FINAL PROVISIONS
18.1 Acceptance of these Terms occurs upon payment of the Security Deposit.
18.2 If any provision is found invalid, the remainder remains in force.
18.3 These Terms apply only to private consumers.
